Description

A 22-year-old accused of sexually assaulting children at Woodland Park in 2024 and subsequently deemed unfit for trial is now back in the Flathead County Detention Center.  

Prosecutors charged Justina Fey Calftail with felony counts of sexual assault and attempted sexual assault following his June 2024 arrest in the public park. But Flathead County District Court Judge Dan Wilson — at the request of Calftail's defense attorney — ordered him to the Montana State Hospital to determine his fitness to proceed on Aug. 8, 2024. 

Officers arrested Calftail after he allegedly groped two young boys near a pavilion in the park about 9:06 p.m., June 27, 2024. The boys' father told investigators he had left the pair playing with Legos while he ran to his car. In his absence, Calftail allegedly approached the older boy and tried to stick his hands down his pants. Then he grabbed the younger boy's genitals and squeezed twice, court documents said.  

The father, who learned about the alleged groping from the older boy upon his return, confronted Calftail, who slapped him, according to court documents.  

The older boy confirmed his father's account in a subsequent forensic interview with investigators, court documents said.  

WHILE CALFTAIL lingered in the county jail awaiting a bed in Warm Springs in the fall of 2024, the state hospital dispatched a doctor to evaluate him, court documents indicate. The doctor diagnosed Calftail with unspecified schizophrenia spectrum or other disorder and deemed him unfit to proceed, Wilson wrote in a subsequent order directing the state hospital to fetch him from Kalispell.  

"[Flathead County Detention Center] is not a mental health facility and due to the limitations of [Flathead County Detention Center], it appears the defendant is not currently receiving adequate mental health care to assist the defendant to gain fitness to proceed," Wilson wrote on Oct. 22, 2025.  

During a Nov. 20, 2025 status hearing, Calftail's defense attorney confirmed that his client was in the care of the state hospital. And as of Dec. 2, Calftail is listed on county jail's roster. 

A status hearing in his case is scheduled for Dec. 18. 

If convicted of either count, Calftail faces between four and 100 years in Montana State Prison and a fine of $50,000.
