A Kalispell man brought up on felony theft and criminal mischief charges in Flathead County District Court was later given suspended sentences and ordered to pay restitution.
Asher Alan McAlpine-Dixon, 23, earned the theft charge in connection with the disappearance of a dirt bike from a West Center Street shop in Kalispell on Feb. 25, 2023. Prosecutors opened the criminal mischief case against him after authorities allegedly found him while responding to a trespass complaint at a U.S. 2 garden center near Kalispell in August 2023.
McAlpine-Dixon was also the defendant in a short-lived felony bail jumping case, which he earned after missing out on a scheduled appearance in district court. A judge ordered that case dismissed in November 2023 after it turned out that McAlpine-Dixon was in custody in Glacier County.
Although McAlpine-Dixon initially pleaded not guilty in the two remaining felony cases, he struck deals with prosecutors in 2024.
In April of that year, McAlpine-Dixon agreed to plead guilty to an amended misdemeanor count of criminal mischief in the trespassing case and pay $1,320 in restitution as well as $175 in court fines and fees.
He pleaded guilty to the amended count before Judge Amy Eddy on April 24, 2024 and received a suspended six-month sentence to the county jail that same day. Eddy also banned him from the garden center's property and gave him credit for seven days of time served.
In August 2024, McAlpine-Dixon reached a deal in the theft case. In exchange for pleading guilty to felony theft, prosecutors agreed to recommend he serve a suspended three-year sentence with the state Department of Corrections to run alongside a case out of Missoula County.
At McAlpine-Dixon's Oct. 17, 2024 sentencing, Judge Dan Wilson handed down the suspended sentence and ordered him to pay $14,774.03 in restitution. Wilson also gave McAlpine-Dixon credit for 17 days of time served.
